Texas man charged with OWI after I380 traffic stop

A San Antonio Texas man was taken into custody early Thursday after allegedly being observed driving while intoxicated.

A Sheriff’s deputy was traveling on I380 northbound near Swisher  just after 2 am when he reportedly noticed 28-year-old Ba Gay leaving the lane of travel several times while speeding. A traffic stop was initiated, and Gay allegedly showed signs of intoxication. They reportedly included bloodshot watery eyes, slurred speech, and the odor of ingested alcohol.

Gay denied any alcohol use, but later stated that he had imbibed earlier in the day.  A nearly-empty bottle of vodka was reportedly discovered under the passenger seat.

After performing poorly on field tests, Gay provided a Datamaster reading showing his breath-alcohol level at .126 percent. He was placed under arrest, and allegedly tensed up and refused to put his hands behind his back. Deputies reportedly had to take him to the ground to comply.

Gay was charged with first offense OWI and Interference with Official Acts, and could be sentenced to up to 13 months in jail if convicted on both counts.
