A Cedar Rapids man is accused of intentionally vomiting on an Iowa City Police officer.

Arrest records indicate 21-year-old Caleb Wagner of C Avenue NW was awaiting processing at the Johnson County Jail on assault charges just before 2 a.m. on April 30th when he said he needed to vomit. Wagner was allowed to leave the squad car and throw up onto South Capitol Street. The officer says he stepped away to avoid the vomit that was being spewed.

Police say Wagner then lifted his chin, turned his head towards the officer, and “projectile expectorated” saliva and chunks of vomit at the officer.

Wagner was additionally charged with Assault on Persons in Certain Occupations. Court records show he reached a plea deal on Monday. A sentencing date has not yet been set.

If convicted after a trial, he would have faced a maximum of one year in jail.

Court records show on Friday Wagner pleaded guilty to the Assault Causing Bodily Injury charges for which he was originally arrested and was fined $900. A Public Intoxication charge was dropped as part of a plea deal with prosecutors.
