A Sigourney man who allegedly gave his brother’s name when stopped for a traffic violation to avoid being jailed for missing a court date got arrested anyway when the brother’s driving privileges were barred.

The incident occurred in Tiffin at around 5:15am last Thursday. 25-year-old Adam Fry of North Jefferson Street was stopped because of a faulty brake light near the intersection of Ireland Avenue and Village Drive.

Upon contact, Fry claimed that he didn’t have a driver’s license on him and proceeded to give his brother’s name and birthdate to the officer. A check using that information determined that Fry’s brother was barred from driving, and Fry was arrested using that information.

A further check of records showed Fry’s true identity, and found that his license was actually suspended for non payment of Iowa fines. He also had an outstanding warrant for failure to appear for a case management conference on December 27th of last year on drug possession charges.

Fry was charged with Malicious Prosecution and providing false ID information. He could be sentenced to up to 13 months in jail if convicted on both counts. His case management conference on the previous charge has been rescheduled for December 19th.
