Iowa City man who demanded officers give him a PBT arrested for intoxication

An Iowa City man who was involved in an altercation on the Iowa City Ped Mall challenged officers to give him a breath test and ended up being arrested for public intoxication.

Police say the incident occurred at 2:50 am Tuesday. 21-year-old Christian Maxson of South Van Buren Street was involved in the altercation, and was reportedly observed with bloodshot watery eyes, impaired speech, unsteady balance, and had the odor of ingested alcohol. Maxson declined to file a report and was told to go home because of his intoxication.

Maxson later returned to the ped mall, and allegedly still had the same signs of intoxication. He then reportedly challenged officers to give him a breath test, which resulted in a blood alcohol reading of .081 percent, just over the legal limit. After his arrest, Maxson asked to take another test, which actually showed a higher reading of .084 percent.

A search subsequent to arrest reportedly turned up a vapor device containing a capsule of gold liquid that Maxson admitted post-Miranda was THC.

He was charged with Public Intoxication, marijuana possession, and possession of drug paraphernalia. Maxson faces a jail sentence of up to 14 months if convicted on all counts.
