Colorado man demands to be arrested after being stopped for speeding

A Colorado man stopped for speeding Tuesday on I-80 demanded to be arrested after refusing to identify himself.

Troopers gave him his wish.

According to the arrest reports, 40-year-old Marc Fishel of Fort Morgan Colorado was stopped at 2:45am after being called in as a reckless driver and clocked going 96 miles an hour in a 65-mile-per-hour zone at the 246 mile marker. He reportedly refused to provide identifying identification other than his first name and demanded that he be arrested.

Fishel was determined to be intoxicated by officers after noting indicators including the odor of alcohol, bloodshot watery eyes and slurred speech. His vehicle was searched for probable cause. Troopers found an open can of Miller Lite containing a small amount of beer, and a large bottle of Fireball Whiskey that had been unsealed and was about three-quarters full.

Fishel refused to cooperate with field sobriety tests, and refused PBT, Datamaster, blood and urine testing.

Fishel had three prior OWI offenses from Michigan, but all were over twelve years old. His refusal to provide information kept police from issuing traffic citations for speeding and driving without a valid license, but he was charged with harassment of a public official and OWI. Fishel could be sentenced to up to 13 months in jail if convicted on both charges.
