A man from Southern Illinois was arrested Tuesday morning after an assault on a stranger at the Old Capitol Town Center.

Just before 10am, the victim was seated in the Center and approached by 35-year-old Daniel Kimes of Danville. Kimes reportedly believed the disabled man was staring at him.

The victim swung his cane at Kimes, who punched the man, took his cane, and hit him with it.  The man suffered a cut to the bridge of his nose and had possible swelling to his right eye.

Police say Kimes and the man did not know each other prior to the alleged altercation.

Kimes was charged with Assault causing Bodily Injury, a serious misdemeanor. If convicted, he could be sentenced to up to a year in jail.
