A Cedar Rapids man who allegedly sexually assaulted a woman on a bar rooftop in 2018 has reached a plea deal.
37-year-old Carlos Hivento reportedly pulled the woman up to the roof. She reportedly told him that she wanted to go back to her friends inside, but Hivento allegedly pulled her to the ground. She hit her head when she fell, and Hivento then reportedly sexually assaulted her.
He was originally charged with 3rd degree sexual abuse; he pleaded to simple assault. Johnson County Attorney Rachel Zimmerman Smith said the victim agreed to the plea deal.
Hivento is already incarcerated. The Gazette reports he was sentenced in April to 10 years for third-degree sexual abuse after a jury convicted him in February for an attack in 2017 on another rooftop bar in downtown Iowa City. A judge ran that sentence consecutively to his previous 34-year sentence for a 2021 conviction of five felony counts of third-degree sexual abuse and two counts of invasion of privacy, for a total of 44 years.
Earlier this month, Hivento pleaded guilty to possession of contraband in a correctional institution, a Class D Felony. He is to be sentenced on that charge July 22nd.
