Solon man reportedly tested at four times over legal limit to drive when arrested for OWI

A Solon man was arrested for OWI over the weekend when he allegedly tested at over four times over the legal limit to drive.

Just before 1:30am Sunday, 27-year-old Preston Miller of Eastwood Drive was at the Capitol Street Parking lot when he was reportedly observed by officers waiting for the ramp gate to go up without paying the fee. Police say the vehicle was running and in the “drive” position.

Miller reportedly showed several signs of intoxication, including bloodshot watery eyes, slurred speech and the odor of ingested alcohol. He allegedly admitted drinking before getting behind the wheel, and an open container of alcohol was observed in his vehicle’s center console.

Officers did not have Miller do physical field tests for his safety.

A PBT showed his breath-alcohol level at .383 percent; a subsequent Datamaster showed it at .327 percent, both over four times the legal limit. Medical experts say people with BAC’s between .3 and .4 percent usually have alcohol poisoning and can experience a loss of consciousness.

Miller was arrested and charged with his third OWI, a Class D Felony punishable by a prison term of up to five years if convicted.
