UI to pay Johnson County family to settle lawsuit over negligence during delivery

The University of Iowa will pay a Johnson County Family $2 million to settle a lawsuit accusing UI Health Care of negligence in the delivery of their son.

The Gazette reports the boy showed signs immediately of injury to his right arm, and was diagnosed as an infant with Erb’s palsy, a muscle weakness commonly caused by injury in childbirth.

The boy is now 14 and has 50 percent mobility in his right arm.

Deputy Attorney General Stan Thompson believed pain and suffering, and loss of function could have led to a more significant award if the case went to trial on its scheduled date of April 2nd. The paid amount will come from UI Health Care’s self-insurance fund.

Also on Tuesday, the State Appeal Board approved a payment of over $5700 to a motorist hit by a former Iowa State University police officer in October who joined a car chase despite being advised not to. The payment covers the total loss of a 2006 Ford Windstar, towing and rental vehicle costs. The officer was subsequently fired and was ordered to return over $2300 in unemployment benefits.
