A judge has granted Jack McCaffery’s motion to waive his appearance at his trial for a traffic violation.
The 17-year-old waived his right to appear during the non-jury trial beginning Tuesday. His attorney will represent him, which is allowed by law in a misdemeanor charge.
McCaffery was cited in July for the violation that occurred at Melrose Avenue and Kennedy Parkway in Iowa City on May 22nd. The teen struck 45-year-old National Guard soldier Corey Hite of Cedar Rapids, who died about two weeks later from his injuries.
McCaffery is the son of University of Iowa head men’s basketball coach Fran McCaffery. In a statement from the coach and his wife Margaret, investigators have told them that it was an unavoidable accident with no evidence to suggest distracted driving.
The teen, who was 16 at the time, has pleaded not guilty to the charge of failure to yield to a pedestrian in the right of way.
