A Judge has rejected a motion filed by a Coralville man’s attorneys who argued that his right to a speedy trial was violated and a murder charge against him should be dropped.

Judge Andrew Chappell said in his ruling that the state followed protocol and the delay in bringing 28-year-old Dimione Walker back from Illinois to face charges in the April shooting was not the prosecution’s fault.

Walker was arrested in a Chicago suburb days after the incident but was held in Illinois to face parole violation charges. He was only extradited after Linn County Attorney Nick Maybanks was able to obtain a governor’s warrant.

Wednesday’s ruling means that Walker’s trial in the murder of 25-year-old Michael Valentine will go on as scheduled on November 8th in Linn County District Court.

The other shooter in the April 10th incident, 32-year-old Timothy Rush, has been charged with fatally shooting 35-year-old Nicole Owens, the mother of his 1-year-old child, and 31-year-old Marvin Cox, who initially survived but then died July 24 from his injuries. His trial is scheduled to begin March 28th.
