Charges to be updated against CR nightclub shooter after another death reported

The Linn County Attorney’s Office says additional charges now face a Cedar Rapids man accused of killing his girlfriend in the Taboo Nightclub shooting after a man he allegedly seriously injured has now died.

The Gazette reports that 31-year-old Marvin Cox of Cedar Rapids was shot in the head on April 10th and died from his injuries on July 24th.

32-year-old Timothy Rush is accused of fatally shooting 35-year-old girlfriend Nicole Owens that night; police say he “fired intentionally and indiscriminately,” with what they believe was a 9 mm handgun, into the large crowd at the club.

An amended criminal complaint stated that the gunshots caused serious injury to two patrons and bodily injuries to three others.

Surveillance video at the nightclub allegedly showed Rush carrying a gun the morning of the shooting. It also captured the shooting and Rush running out of the club afterwards.

The newspaper also reports that Rush was working security at Taboo that night. A subsequent search of his home found a firearm that matched up with shell casings from the club.

Rush is set to go on trial March 28th. He already faces 15 felony charges.

The other alleged shooter, 29-year-old Dimione Walker, is accused of shooting 25-year-old Michael Valentine to death. He’s currently in Stateville Prison in Joliet Illinois on parole violations for being in possession of a weapon. He was arrested in a Chicago suburb 8 days after the shootings.

When extradited back to Iowa, he faces charges of first-degree murder, intimidation with a dangerous weapon, going armed with intent, and being a felon in possession of a firearm.
