An Amana man whose reported failure to yield led to the death of a woman has been formally charged nearly a year after the accident occurred.
The Iowa State Patrol reported that just after 10 pm Sunday December 13th, 2020, 34-year-old John Nagel of Amana was driving his Dodge Ram westbound on 120th Street when he failed to yield at its intersection with Highway 151. Nagel hit a southbound Toyota broadside; 31 year old Jessica Ann Marie Schulte of Upper South Amana was pronounced dead at the scene. Nagel was taken to the University of Iowa Hospitals and Clinics, while the driver of the Toyota, 25 year old Michael Humina of Amana, was taken to Compass Memorial Hospital.
A check of Iowa Courts shows that an order to issue a warrant for Nagel’s arrest was issued this past December 10th; Nagel was served with the warrant on January 11th.
He was being held in the Iowa County Jail and his arraignment has been rescheduled to February 14th.
Nagel has been charged with Homicide by Vehicle while operating under the influence and Serious Injury by Vehicle. If convicted on both counts, Nagel could be sentenced to up to 30 years in prison.
Court records also show that Nagel was charged with Possession of a Weapon in a Correctional Institution just last week. That’s a Class C felony punishable by an additional ten years if convicted. A preliminary hearing on that charge is scheduled for February 15th.
