A pizza delivery driver from Kalona was arrested in Iowa City early Sunday morning after being charged with his second OWI.
Police were called to the 200 block of East Court Street around 3:30 am on reports of a fight involving 43-year-old Michael Kelly of 2nd Place. He allegedly admitted to driving because he is a pizza delivery person.
Kelly was reportedly extremely unbalanced and police say he had to be up against something to keep from falling over. He allegedly had slow and slurred speech, pausing several times to, in his words, “think.” Kelly also reportedly admitted to taking colazepam for anxiety.
He showed measurable impairment on field testing, but chemical testing showed no alcohol in his bloodstream. A Drug Recognition Expert was able to determine he was under the influence of a depressant and unable to operate a vehicle safely.
Kelly was charged with OWI second offense, an aggravated misdemeanor punishable by up to two years in jail if convicted.
