A Fairfax man has been arrested after a one-vehicle accident in Swisher.
Johnson County Sheriff’s deputies were called to 216 3rd Street SW in Swisher just after 9:30 Friday night for a male who had crashed his car into a yard. Arriving officers found the 2006 Cadillac XLR wedged from a yard to a ditch, with the reported driver standing nearby.
The man was identified as 24-year-old Benjamin Selzer of 76th Avenue SW. He allegedly showed signs of intoxication, admitted to drinking earlier, and reportedly admitted to getting his car stuck in the ditch, saying he knew “not to drive anymore”.
Deputies say Selzer was either unwilling or unable to properly conduct field sobriety testing, and refused a portable Breathalyzer test. A Datamaster result showed his blood alcohol level at .208%.
Selzer was arrested and charged with Operating While Intoxicated – 2nd Offense. He received a deferred judgement on a previous OWI charge in 2019.
