An Iowa City man who has been convicted of OWI at least three times in the last 12 years has been charged with another after allegedly driving drunk to the Waterfront HyVee on Sunday.

Arrest reports indicate that 58-year-old Herbert Mather was called in as an intoxicated male, as he allegedly stumbled into the store at 3:48pm after exiting his 2001 Ford Taurus. An officer observed Mather leaving the lot in his vehicle and initiated a stop after he reportedly failed to maintain his lane and ran a stop sign.

Mather was said to smell strongly of ingested alcohol, had slurred speech and impaired balance. He showed multiple signs of impairment on SFSTs, and agreed to a post-arrest PBT showing a blood/alcohol level of .248. He refused Datamaster testing.

A check of his records showed his driving status as revoked until November for OWI test failure. Mather also had three or more OWI convictions in the last twelve years, most recently in October of 2019.

Mather was charged with OWI third or subsequent, and driving while license denied or revoked. If convicted on the charges, he could be sentenced to up to seven years in prison.
