A Swisher man has been taken into custody and charged with domestic abuse assault after allegedly slamming the victim into a wall and making her immobile.

According to arrest reports, 50-year-old John Ervin of Thorncrest Court Northeast and the woman have been living together for several years. The incident started Monday at 1:20am, as a verbal argument turned physical.

Ervin allegedly slammed the victim into a wall causing her to strike her back. The woman reportedly has a pre-existing back condition that Ervin’s assault caused to flare up again. She suffered pain and was allegedly rendered immobile due to the incident.

Ervin was taken into custody and charged with domestic abuse assault causing injury, a serious misdemeanor punishable by a maximum sentence of a year in jail if convicted. A no-contact order was requested between the two parties.
