Ferentz family wins dispute with neighbors

Iowa head football coach Kirk Ferentz and his wife have won their dispute with their neighbors.
Judge Chad Kepros has ruled that the Ferentz’s never agreed to join the Saddle Club Road Homeowners Association, and therefore were not subject to its rules. The ruling means the Ferentz’s do not need to pay the Association’s $9,500 assessment for road maintenance. It also lifts a lien the Association had placed on the Ferentz’s $1.2 million home.
The dispute between the Ferentz’s and the Association involved whether the Ferentz’s should have been required to remove or trim trees and other landscaping they erected in an easement. Kepros ruled the trees do not interfere with travel on the road.
Kepros also ruled that the plaintiffs in the case are required to pay the cost of the lawsuit. They include Ferentz neighbors John and Ann Marie Buatti, Gary Watts, Becky Watts, Elayne Sexsmith and Fred Page.
The plaintiffs have filed another lawsuit against the Ferentz’s for breach of contract, claiming they originally agreed to join the Association in 2001. Trial in that case is set to begin on June 9, 2020.
